Over the past year, the Court of Appeal for Ontario has presided over many appeals involving commercial lease disputes. This influx of appellate cases includes disputes between landlords and tenants involving:
- pre-contractual misrepresentations;
- consent to lease assignments;
- apportionment of taxes;
- limitation periods for rent arrears, and
- the application of force majeure clauses as a result of COVID-19 lockdowns.
